Privacy Policy
Last Revision August 21, 2008

RIPL Corp: ("RIPL,” “we,” “us," or “our”) recognizes that its customers, visitors, and users (collectively or individually "Users") value their privacy. As a product, RIPL allows Users to discover, share and communicate about content in exciting new ways, and RIPL wants to insure that all Users are fully informed about its capabilities. This Privacy Policy details important information regarding the use and disclosure of User information and content collected on the RIPL web site (including but not limited to RIPL pages generated by Users, the “RIPL Site”) and in the RIPL software and applications installed on Users’ desktops and third party web sites (the “RIPL System”). RIPL provides this Privacy Policy to help you make an informed decision about whether to use or continue using RIPL, and what information to provide to RIPL.

This Privacy Policy is incorporated into and is subject to the RIPL Terms of Service. Your use of RIPL and any personal information you provide on RIPL remains subject to the terms of this Privacy Policy and our Terms of Service. Please note that any photo, image, or other content posted at the direction of Users onto RIPL becomes published content and is not considered personally identifiable information subject to this Privacy Policy.

Information RIPL collects and how we use it: In order to provide our full range of services, we may collect the following types of information:

Information you provide: When you sign up for RIPL, we ask you for personally identifiable information (such as your name, email address, and password). We use your personal information to operate, maintain, and provide to you the features and functionality of RIPL, such as verifying your identity before providing access to your account and providing a variety of personalization options. We may combine the information you submit under your account with information from third parties in order to provide you with a better experience and to improve the quality of our services. For certain services, we may give you the opportunity to opt out of combining such information.

We do not use your email address or other personally identifiable information to send commercial email or marketing messages without your consent except as part of a specific program or feature for which you will have the ability to opt in or opt out. We may, however, use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major RIPL System changes or for customer service purposes).

In addition, you may, as part of RIPL’s core functionality, receive alerts and notifications via email when certain Users publish content that aligns with your preferences, and those Users may include commercial entities. Further, commercial content may appear at any time within the content stream that RIPL distributes to its Users on the RIPL Site or in the RIPL software or in the RIPL System. RIPL provides a variety of ways in which its Users may subscribe or unsubscribe to such content, block it, or filter it, and RIPL may also filter such content automatically on your behalf in order to improve the relevancy of the content you receive.

Cookies information: When you visit the RIPL Site, we may send one or more cookies (small text files containing a string of alphanumeric characters) to your computer that uniquely identify your web browser. We use cookies to improve the quality of our service by storing user preferences and tracking user trends. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Some features and services of the RIPL System may not function properly if your cookies are disabled.

Cookies Log File information: When you use RIPL, our servers automatically record information that your browser sends whenever you visit any website. These server logs may include information such as the page or content requested, your Internet Protocol ("IP") address, browser type, browser language, referring/exit pages and URLs, operating system, number of clicks, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookie serial numbers that may uniquely identify your browser.

Cookies Clear GIFs information: When you use the RIPL Site, we may employ "clear GIFs" (a.k.a. web beacons) which are used to track the online usage patterns of our Users anonymously (i.e., in a non-personally-identifiable manner). In addition, we may also use clear GIFs in HTML-based emails sent to our Users to track which emails are opened by recipients.

Cookies User communications: When you send email or other communication to RIPL, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.

Cookies Affiliated sites: We offer some of our services in connection with other web sites. Personal information that you provide to those sites may be sent to RIPL in order to deliver the service. We process such information in accordance with this Privacy Policy. The affiliated sites may have different privacy practices and we encourage you to read their privacy policies.

Cookies Links: RIPL may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our services, customized content, and advertising.

Cookies “Friending” and subscription information. RIPL allows you to connect with other people and commercial entities for the purpose of receiving content they have produced or consumed, and it allows other people to connect with you with or without your consent depending on the particular feature. The people and entities with whom you have chosen to affiliate may be displayed to other Users along with the content they have produced or consumed. RIPL provides a variety of ways for you to permit or restrict the creation and display of such relationships.

Cookies User-published content: Any personal information or video content that you voluntarily disclose online (i.e., publish via RIPL) becomes publicly available and may be collected and used by others. Your username and avatar (not your email address) is displayed to other Users when you upload content (including photos, music lists, pointers to music and video, contacts, RSS feeds, text, and other content) or send messages through RIPL. In addition, other Users can contact you through RIPL messages and comments. Any content that you upload to the RIPL Site may be redistributed through the internet and other media channels, and may be viewed by the general public. Although RIPL provides features that allow you to restrict access to individual content items to specific people, RIPL offers no guarantees that such content may not be accessed or disclosed due to system, operator or User error.

Cookies When RIPL discloses information: We provide personally identifiable information and non-personally-identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We require that these parties agree to process such information in compliance with our privacy policy, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

We do not share or rent your name or email address with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt in or opt out. However, commercial entities may see your RIPL username and avatar just as any other User can, and they may contact you via RIPL’s messaging systems just as any other Users can. RIPL provides a variety of ways for you to reduce or eliminate such contact if you choose to do so. You can opt out of RIPL’s email programs using the links that appear at the bottom of each email.

We may share non-personally-identifiable information (such as anonymous User usage data, referring/exit pages and URLs, operating systems, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the RIPL Site.

We may release personally identifiable information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law) or respond to a court order, subpoena, or search warrant.

RIPL also reserves the right to disclose personally identifiable information and/or non-personally-identifiable information that RIPL believes, in good faith, is appropriate or necessary to enforce our Terms of Service, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the RIPL Site, and to protect the rights, property, or personal safety of RIPL, our Users or others.

Your choices for personal information: When you sign up for a particular service that requires registration, we ask you to provide personal information. If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.

If we propose to use personal information for any purposes other than those described in this Policy and/or in the specific service notices, we will offer you an effective way to opt out of the use of personal information for those other purposes. We will not collect or use sensitive information for purposes other than those described in this Policy and/or in the specific service notices, unless we have obtained your prior consent.

You can decline to submit personal information to any of our services, in which case RIPL may not be able to provide those services to you.

To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to change your page or personal information. You are responsible for maintaining the secrecy of your unique password and account information at all times.

Third-party advertisers and links to other sites: RIPL allows other companies, called third-party ad servers or ad networks, to display advertisements on RIPL System. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on your RIPL page or RIPL receiver software. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of advertisements and to personalize the advertising content you see.

RIPL does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. The advertiser may also use information regarding your use of RIPL (such as the number of times you viewed an ad), but not any personally identifiable information, to determine which ads to deliver to you.

You should consult the respective privacy policies of our third-party ad servers or ad networks for more information on their practices and for instructions on how to opt-out of certain practices. This Privacy Policy does not apply to, and we cannot control the activities of, such other advertisers or web sites.

Please contact us at the address below for any additional questions about the management or use of personal data.

Our commitment to data security: We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. RIPL uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal

information. We cannot, however, ensure or warrant the security of any information you transmit to RIPL and you do so at your own risk. Once we receive your transmission of information, RIPL makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

We restrict access to personal information to RIPL employees, contractors, and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

If RIPL learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. RIPL may post a notice on RIPL if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should notify us by email at info@ripl.com.

When we receive formal written complaints, it is RIPL's policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between RIPL and an individual.

Our commitment to children's privacy: Protecting the privacy of young children is especially important. For that reason, RIPL does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the RIPL Sites from persons under 13 years of age, and no part of our website is directed to persons under 13. If you are under 13 years of age, then please do not use or access the RIPL Sites at any time or in any manner. If RIPL learns that personally identifiable information of persons under 13 years of age has been collected on the RIPL Sites without verified parental consent, then RIPL will take the appropriate steps to delete this information.

Special note to international users: RIPL is hosted in the United States and is intended for and directed to Users in the United States. If you are a User accessing the RIPL Sites from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the RIPL Sites, which are governed by U.S. law, this Privacy Policy, and our Terms of Service, you are transferring your personal information to the United States and you consent to that transfer.

Data integrity: RIPL processes personal information only for the purposes for which it was collected and in accordance with this Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

In the event of merger, sale, or bankruptcy: In the event that RIPL is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used.

Changes to this Privacy Policy: This Privacy Policy may be revised periodically and this will be reflected by the effective date below. Please revisit this page to stay aware of any changes. Your continued use of the RIPL Site and/or any part of the RIPL System constitutes your agreement to this Privacy Policy and any future revisions.

We will post any Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Policy changes). Each new version of this Policy will be identified by its effective date below.
